Terms of Service

1. Acceptance of these terms

By accessing or using Daily Work Pad (the “app”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the app.

These terms are between you and the Daily Work Pad team. “We”, “us”, and “our” refer to that entity. “You” means the teacher or other individual using the app.

2. Beta software, provided as is

Daily Work Pad is currently in private beta. Beta software is experimental. Features may change, break, or be removed without notice. The app is provided “as is” and “as available”, without any warranty of any kind, whether express or implied.

In particular, we make no warranty that:

  • the app will be available at any particular time or free from errors;
  • data stored locally will not be lost due to device failure, browser updates, or bugs;
  • the app is suitable for any specific compliance or regulatory purpose; or
  • AI-generated content is accurate, complete, or appropriate for use without review.

You should maintain your own backups of important teaching records using the app’s export tools. Do not rely on the app as your only copy of critical data.

3. Your responsibilities as a teacher using this app

Because Daily Work Pad processes information about students, your responsibilities as the user are central to the app’s privacy model. By using the app, you agree to:

  • Use the Student Identity Vault correctly. Add student names using the official student import or entry tools, so they are stored in the vault and referenced by UID everywhere else. Do not bypass this by typing student names directly into lesson plan fields, notes, or the AI assistant.
  • Do not type student names into free-text or AI fields. The AI assistant has a client-side guard that tries to detect this, but the guard is not infallible. You are responsible for your own inputs.
  • Understand that you are the data controller. You and your school employer are responsible for how student information is handled. Daily Work Pad provides tools to support good practice; it does not take on legal liability for the information you choose to enter.
  • Ensure your use of the app complies with your school’s IT and privacy policies, your employer’s directions, and applicable state education department requirements.
  • Use the app only for lawful, professional teaching purposes.

4. Acceptable use

You agree not to:

  • use the app for any unlawful purpose or in violation of any applicable law;
  • attempt to reverse engineer, decompile, or tamper with the app;
  • use the AI assistant to generate content that is harmful, discriminatory, or inappropriate for an educational setting;
  • share access to the app with others in a way that could expose their students’ information to unauthorised parties; or
  • use automated tools to scrape, stress-test, or interfere with the app or its infrastructure.

5. Intellectual property

The Daily Work Pad software, design, and branding are owned by or licensed to us. Your use of the app does not transfer any ownership of intellectual property to you.

Your teaching content stays yours: lesson plans, notes, and materials you create. We claim no ownership over content you enter into the app. When cloud sync is enabled, we store a copy solely to provide the sync service.

Curriculum content is reproduced, not paraphrased. The Australian Curriculum content descriptions in this app are ACARA’s own words, taken from the machine-readable curriculum ACARA publish, and used under the Creative Commons Attribution 4.0 International licence. Copyright in that material belongs to ACARA, the attribution they require is shown wherever the material appears, and the material is not modified. ACARA does not endorse this product and is not affiliated with it. State syllabus references, where the app carries them, belong to the relevant state authority on that authority’s own terms.

6. AI-generated content disclaimer

The AI assistant generates suggestions based on the masked context you provide. AI-generated content:

  • may be inaccurate, incomplete, outdated, or unsuitable for your specific students or context;
  • does not constitute professional educational, legal, or psychological advice;
  • must be reviewed by you before use in any teaching activity, official report, or communication with students or parents; and
  • is your responsibility once you use or share it. We accept no liability for decisions made on the basis of AI-generated output.

7. Limitation of liability

To the maximum extent permitted by Australian law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the app, including (without limitation) loss of data, loss of teaching records, or loss of income.

Where consumer guarantees under the Australian Consumer Law apply and cannot be excluded, our liability is limited (at our option) to resupply of the relevant service or the cost of having the service re-supplied.

Nothing in these terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by law that cannot lawfully be excluded or limited.

8. Account, suspension, and termination

During the private beta, accounts are created by invitation only. We reserve the right to suspend or terminate access to the cloud features (account and sync) at any time if we reasonably believe there has been a breach of these terms, misuse of the service, or for operational reasons.

Because core functionality is local-first, suspending or terminating your cloud account does not delete the data on your device. You keep access to your locally stored teaching data. You can export that data at any time.

You may stop using the app at any time. To delete your account and any associated cloud data, use the data deletion option in Settings or contact us at support@dailyworkpad.com.

9. Governing law

These terms are governed by the laws of Western Australia, Australia, and each party submits to the non-exclusive jurisdiction of the courts of that state or territory.

10. Changes to these terms

We may update these terms from time to time. When we do, we will post the revised terms at this URL and update the “last updated” date at the top. For material changes, we will notify you in the app. Your continued use of the app after a change takes effect constitutes your acceptance of the updated terms.

During the private beta, we may change these terms frequently as the product evolves. Please check back regularly.
